Thanks. Ahh, yes, now I do remember reading about the White House spin cycle, and Rove heading that too.

Thanks for reminding me of that. You always have provided alot of information, and I value your posts and insight very much.

Sounds like in order to "be in the know" reporters are expected to jump through hoops. On a similar note, I saw last night on some news program that U.S. guards made a male detainee wear a bra, dance with another male, and act like a dog. That in my mind explains why Jeff Gannon was allowed to be part of the White House Press Corp.

Anti-Bush Protester Sues Houston Cops

An anti-Bush protester has sued several police officers, accusing them of violating his free-speech rights after he was arrested last year for carrying a sign that read, "No more Bush-it."

Chris Kelly, 43, filed the federal lawsuit Wednesday against officer David Weaver, 37, 10 unidentified officers and an unidentified supervisor of the Houston Police Department.

Kelly was holding the cardboard sign near a crowd of Houston Astros baseball fans on Oct. 18 when police approached him. Police handcuffed him, put him into a police car and drove through downtown before releasing him without explanation, the lawsuit alleges.

A municipal judge later dismissed the misdemeanor citation.

The lawsuit asks U.S. District Judge Kenneth Hoyt to declare that Kelly's rights were violated under the U.S. and Texas constitutions.

Kelly, represented by the Texas Civil Rights Project, said he filed the lawsuit "so that I and other Houstonians can feel free to express our political views about our government without the threat of assault and arrest and bogus prosecution by the police."

Police spokesman Alvin Wright said Weaver could not comment because he had not been served with the lawsuit.

Jim Harrington, director of the Texas Civil Rights Project, said Kelly's arrest was part of a pattern in Texas of discouraging protests against the president.

Similar incidents include five protesters who were jailed two years ago as they headed to protest the Iraq war at Bush's ranch. The city of Crawford agreed to a $43,000 settlement in the case.

And in a case pending in Travis County, protesters are suing Austin police for keeping them from crossing a street to reach the front of the Governor's Mansion in 2001, Harrington said.

Very interesting. O'Donnell is convinced (from reading the judges written opinions on this case) that its a big story, possibly compromise of national security, and that Plame was covert. Its possible several people will be charged, on different charges, but the most serious charge is for who first outed Plame, to Novak, to discredit Wilson....that brings this back to WMD/ Niger, and the run up to the war.

Lawrence, good to have you here. What made you decide to go public?

LAWRENCE O'DONNELL, POLITICAL ANALYST: Well, I knew about what was in the "TIME" magazine e-mails for several months, but I didn't want to reveal it at a time when it would interfere with the litigation and interfere with the appeals process that was going on. So Lou, I decided to reveal it actually within the hour that "TIME" magazine was handing over its e-mails to the prosecutor.
There are two reasons for that. One is I avoided any subpoena by the prosecutor for that.

DOBBS: Right.
O'DONNELL: If I had revealed it months before, the prosecutor would have been right to subpoena me and ask me how I knew it. And I was just revealing something that the prosecutor was going to know within the hour of reading those documents at that point.

DOBBS: You also said categorically on "The McLaughlin Group" television broadcast that Karl Rove was the source of the Matthew Cooper report. How long have you known that?

O'DONNELL: I've known it for several months, Lou. And one of the amazing things about that secret is how loosely it was actually held.

I just -- all I'll say about it is, it wasn't that hard for me to come by. And I didn't work hard at it. I was able to pick it up, though. And then after I revealed it publicly, I picked up a couple more confirming sources about it, highly authoritative sources.

DOBBS: Lawrence, as you may suspect, I'm dying to ask you what your sources are for that.

O'DONNELL: And I'm in that "can't reveal my sources" game, Lou, just like the other reporters in this case.

The difference is -- one difference, though, is that what I've done is I've actually tried to advance public knowledge of what's going on in the story as opposed to Judy Miller and Matt Cooper. They have actually been making efforts to prevent the public from discovering what's going on in the story, which is understandable from their perspective.

DOBBS: And certainly, to prevent rather than the public not knowing to at least expand the body of public knowledge and to do that, sometimes it is absolutely necessary, certainly in the case, Judith Miller and her views and her principles, which most of us in this craft adhere to. She thinks she has the right to protect her sources, and so do I, and so do a lot of other journalists.

O'DONNELL: Well, Lou, one of the judges -- one of the judges on the appeals court does, too. One of the judges, in an ignored opinion by the press, found that there is indeed a federal shield law, but what he said was, the gravity of the suspected crime in this case is so serious that it overwhelms any right to privilege that these reporters have.

He went so far as to say that if the leak involved was less harmful to national security, that's a quote from the judge, if it was less harmful to national security, he would not order the reporters to testify.

DOBBS: It's interesting that the investigation into this case, and particularly as the principal victims here now appear to be in this order Judith Miller, "The New York Times" Pulitzer Prize winning journalist who is now in, I believe, her eighth full day of being in prison. And basically the American taxpayer is paying for an investigation that so far has led nowhere.

It's a remarkable period. And we now know that Karl Rove was both a leaker and a leakee, if you will. That we're in this sort of bizarre situation in which apparently Karl Rove -- well, the press was leaking to the government in this case, Robert Novak talking to Karl Rove. Are you astounded by that development?

O'DONNELL: No Lou, over a year ago, one of the lawyers in the case indicated to me that he expected it to be one that included the echo effect. Which is to say Rove's information may well have come to him first from the press. That turns out to be apparently the structure of the story now.

But Lou, this is a very serious case. And I say that based exclusive on the judges' opinions. You can't read the judges' opinions in this case and think that this prosecutor is chasing his tail. These judges were reluctant to order these reporters to testify or into jail. And they have said that they have done so, because the underlying suspected crime is so serious. And they're talking about the leak case.

In fact, Lou, one of the judges refers to, quote, "the plot against Wilson." One of the appeals court judges sees this case as a plot against Joe Wilson. That's not spin from a political source, that's one of the judges' reading of the case.

DOBBS: And my readings of those judges' opinions frankly, somewhat constrained, because so much is redacted.

O'DONNELL: That's right.
DOBBS: And that is hardly helpful in this case either. Reports today that the neighbors of Valerie Plame, for example, and this is all part of the spin war that is underway, obviously, but reports today that Valerie Plame was well-known to her neighbors and friends as an employee of the CIA. This story compounds itself with complexity, contradiction, as well as talking points, of course.

O'DONNELL: Well, there are other neighbors who say they never knew she worked for the CIA.

But Lou, witness No. 1 in this grand jury had to be an administrator from the CIA who clearly established, legally, that Plame fits the definition of covert agent according to the statute. If witness No. 1 did not say that to the grand jury, no one would call witness No. 2.

And when the you read these judges' opinions, they are constantly referring to this being case about revealing the identity of a covert agent.

DOBBS: All right -- I'm going to turn to you right now. We're out of time. But I've got to ask you the last question. And that is what happens in your judgment, is Karl Rove in serious trouble here? What will be the consequences in conclusion when the special prosecutor wraps this up?

O'DONNELL: Well, his lawyer says he hasn't been a target of the case, but he is a subject of the case. That's one step below target. He could switch to target depending what Matt Cooper's testimony is.

The prosecutor's going to have to wrap this up, because after Cooper, there's no one else to talk to. And every indication from the prosecutor's conduct of this case is that he is going after a very serious crime. Who the criminal is remains the mystery.

That is so incredibly true, and so incredibly sad.

It is baffling, because if people just lay down the dogma, (or as Indy says - 'kick the dogma')
the message is pretty straight forward. Unfortunately human beings have always found it to be boring and to not produce the rewards they want, so they decide to do it their way, then greed and the lust for power takes over. They become consumed with how to aquire more money and more power, and lose contact with that part of themselves that consists of character and character building principles. They become shallow and hardened to people who genuinely have needs, and I believe we are seeing what it looks like when they cross the line of decency and compassion, and conscience. We have lamented about how they just don't care about people, and now that is a given.

I was telling DiAnne when we met one day, that she would probably really enjoy watching the movie "Seven Years In Tibet". It tells the story of the Dali Lama in Tibet at the time the Communist Chinese took it over, and it deals alot with the peaceful gentle doctrine of the Buddhist religion. It has gorgeous scenery, too, along with Brad Pitt.

I am glad we are fortunate enough to have each other to share information and motivate and encourage each other. The year I knew there was something rotten in Denmark but didn't know where to go to find the truth was some of the longest and most frustrating months in my life. I hated being lied to through the media.

AfterDowningStreet.org ("ADS") is the citizen's coalition advocacy group organized to raise awareness of the leaked British memos and minutes referred to as the "Downing Street Documents". Those documents, first reported by Michael Smith of the Sunday Times suggest that the Bush Administration had determined to topple Saddam Hussein by military means and planned to "fix" the facts and intelligence around the policy" at least eight months prior to receiving authorization of the U.S. Congress to wage war in Iraq. I will get a copy! I remember several people from the Kerry blog were reading it right before the election, and were loving it. Some of them took it on their business flights and read it then.

When the book first came out, Wal-Mart had it, but it was funny....as soon as they sold out of their original stock, they never restocked it. Might have been because Wal-Mart is red. I hate to pay full price for a book, retail is 40% over wholesale prices. I will see what I can do at Amazon.

Waxman explains that the nondisclosure agreement signed by Karl Rove prohibited Mr. Rove from confirming the identity of covert CIA agent Valerie Wilson to reporters. Under the nondisclosure agreement and the applicable executive order, even "negligent" disclosures to reporters are grounds for revocation of a security clearance or dismissal.

Karl Rove's Nondisclosure Agreement Today, news reports revealed that Karl Rove, the White House Deputy Chief of Staff and the President's top political advisor, confirmed the identity of covert CIA official Valerie Plame Wilson with Robert Novak on July 8, 2003, six days before Mr. Novak published the information in a nationally syndicated column. These new disclosures have obvious relevance to the criminal investigation of Patrick Fitzgerald, the Special Counsel who is investigating whether Mr. Rove violated a criminal statute by revealing Ms. Wilson's identity as a covert CIA official.

Independent of the relevance these new disclosures have to Mr. Fitzgerald's investigation, they also have significant implications for: (1) whether Mr. Rove violated his obligations under his "Classified Information Nondisclosure Agreement" and (2) whether the White House violated its obligations under Executive Order 12958. Under the nondisclosure agreement and the executive order, Mr. Rove would be subject to the loss of his security clearance or dismissal even for "negligently" disclosing Ms. Wilson's identity.

KARL ROVE'S NONDISCLOSURE AGREEMENT

Executive Order 12958 governs how federal employees are awarded security clearances in order to obtain access to classified information. It was last updated by President George W. Bush on March 25, 2003, although it has existed in some form since the Truman era. The executive order applies to any entity within the executive branch that comes into possession of classified information, including the White House. It requires employees to undergo a criminal background check, obtain training on how to protect classified information, and sign a "Classified Information Nondisclosure Agreement," also known as a SF-312, promising not to reveal classified information.1 The nondisclosure agreement signed by White House officials such as Mr. Rove states: "I will never divulge classified information to anyone" who is not authorized to receive it.2

THE PROHIBITION AGAINST "CONFIRMING" CLASSIFIED INFORMATION
Mr. Rove, through his attorney, has raised the implication that there is a distinction between releasing classified information to someone not authorized to receive it and confirming classified information from someone not authorized to have it. In fact, there is no such distinction under the nondisclosure agreement Mr. Rove signed.

One of the most basic rules of safeguarding classified information is that an official who has signed a nondisclosure agreement cannot confirm classified information obtained by a reporter. In fact, this obligation is highlighted in the "briefing booklet" that new security clearance recipients receive when they sign their nondisclosure agreements:

Before confirming the accuracy of what appears in the public source, the signer of the SF 312 must confirm through an authorized official that the information has, in fact, been declassified. If it has not, confirmation of its accuracy is also an unauthorized disclosure.3

THE INDEPENDENT DUTY TO VERIFY THE CLASSIFIED STATUS OF INFORMATION

Mr. Rove's attorney has implied that if Mr. Rove learned Ms. Wilson's identity and occupation from a reporter, this somehow makes a difference in what he can say about the information. This is inaccurate. The executive order states: "Classified information shall not be declassified automatically as a result of any unauthorized disclosure of identical or similar information."4

Mr. Rove was not at liberty to repeat classified information he may have learned from a reporter. Instead, he had an affirmative obligation to determine whether the information had been declassified before repeating it. The briefing booklet is explicit on this point: "before disseminating the information elsewhere ... the signer of the SF 312 must confirm through an authorized official that the information has, in fact, been declassified."5

"NEGLIGENT" DISCLOSURE OF CLASSIFIED INFORMATION

Mr. Rove's attorney has also implied that Mr. Rove's conduct should be at issue only if he intentionally or knowingly disclosed Ms. Wilson's covert status. In fact, the nondisclosure agreement and the executive order require sanctions against security clearance holders who "knowingly, willfully, or negligently" disclose classified information.6 The sanctions for such a breach include "reprimand, suspension without pay, removal, termination of classification authority, loss or denial of access to classified information, or other sanctions."7

THE WHITE HOUSE OBLIGATIONS UNDER EXECUTIVE ORDER 12958

Under the executive order, the White House has an affirmative obligation to investigate and take remedial action separate and apart from any ongoing criminal investigation. The executive order specifically provides that when a breach occurs, each agency must "take appropriate and prompt corrective action."8 This includes a determination of whether individual employees improperly disseminated or obtained access to classified information.

The executive order further provides that sanctions for violations are not optional. The executive order expressly provides: "Officers and employees of the United States Government ... shall be subject to appropriate sanctions if they knowingly, willfully, or negligently ... disclose to unauthorized persons information properly classified."9

There is no evidence that the White House complied with these requirements.

In the USA, the curtain opened on new anti-terror follies Wednesday when three Senate committees, in blustery response to the London bombings, voted to extend the power of the FBI under the Patriot Act to obtain library records without a subpoena. Exactly what suicide bomber or sleeper cell has so far been exposed by this powerful new intelligence weapon, we are not told. Did Osama fail to return his copy of 'Harry Potter'? Or 'Hijacking for Idiots'?

What we have here is the great con: to get us to pull each other's hair over the sanctity of library card privacy. We're dragged into some nit-wit debate over the "balance between security and civil liberties" - with the defenders of America against terrorism sneering at the sissies from the ACLU.

Civil libertarians are all shook up that the FBI is going through our summer reading list. My concern is deeper. What I want to know is, who at the FBI is poring over my choice of novels, how much do we pay this guy and why isn't he reviewing Swiss and Pakistani bank transfer records instead?

If our nation's safety depends on enlisting Miriam the Librarian for anti-terror espionage, then I'm checking out.
