Election 2006
The other night, at a 30-year retrospective for the Liz Lerman Dance Company, Peter DiMuro, her Artistic Director, stepped forward and led the audience through a movement exploration around the issue of genocide. The last gesture in the series we came up with was one in which we wrote the initials of someone who had stood up for us on our palms.
Then we took the initials and gave the hand gesture to the rest of the audience. It was moving and lovely and I had no trouble thinking of whose initials belonged inside that movement.
And tonight I went to the Vietnam Memorial to meet up with Cindy Sheehan and Ann Wright and others for a vigil. Cindy spoke about the hope we all have for tomorrow and for the end of this war, hopefully before the number of names surpass those on that wall.
She also pointed out that if we added the Iraqi names of those killed, the wall would be twelve times the size it is, and if we added the names of the Vietnamese killed, it would be double that.
Who stands up to genocide? Who speaks for those ghosts?
Tomorrow we vote, and it is a most important election, because it is surely our last chance to end this particular genocide. It may be the last chance to end the genocide of the planet.
And I know you all understand this and have already worked blessedly hard to get out the vote. But after you vote yourself, please take a moment to think about those who have lost lives for profiteering, those who have suffered under this administration, and vow to prevent these criminals from continuing with their program of callousnes and callowness.
Write the initials of someone who has stood against them on your hand and say thank you. And then pick up the phone and call your local organization and ask what small thing you can do to make the difference between despair and hope.
Everything counts on this day. Everything.

Tomorrow, as I divide the day between beating the streets canvassing neighborhoods and driving people to their local polling places so they can participate in this great experiment we call a representative democracy, I'm sure that more than one of the people I meet will ask me why I have initials written on the palms of my hands. Now is not the time to retreat. Vote, and then find evidence to tell the story of what's really happening in U.S. elections.
Things may look relatively smooth on election day, but the real fun begins after the polls close. That's when we see a lot of strange things. Look for:
- Missing memory cards -- and remember, a memory card is a BALLOT BOX. This happens every election, to weird shrugs by election officials. About 70 ballot boxes went missing in Cuyahoga County during the May primary; a bunch went missing in Detroit last spring, and they've gone missing in places like Dekalb County Georgia, and various other locations. This is nothing to shrug about.
Remember when a single ballot box was missing in Florida in the 2000 election? Everyone was going crazy, but now, you have dozens and dozens of these memory cards, cartridges, and "PEBs" -- all are small digital ballots boxes -- they are going missing. Very troubling. Watch for it. See if you can spot it. Report it!
- Phantom votes -- this is when you have more votes than voters. There were about 100,000 more votes than voters in Tarrant County Texas during the primary, and more votes than voters in Ohio locations in 2004.
What to look for: Do a quick check of the number of registered voters and compare with the number of votes that show up. Bizarre anomalies appear almost every election.
Stage 2 is comparing the number of sign-ins in the pollbook with the number of votes that show up.
- Sometimes you see disappearing votes. The number of votes goes DOWN while the number of precincts counted goes UP. This happened in Mohave County Arizona in the 2004 primary, and in Memphis in the Aug. 2006 primary. Alert watchers of county Web results often spot this and capture it in screen saves.
What to do: Assign someone to capture screen shots each time the totals are updated and check for disappearing votes.
- Obstructed vote counting -- we often see obstructions to being able to see the vote counting, even beyond the obstruction of counting inside a black box. In San Diego in 2005, a member of the Black Box Voting board of directors, Jim March, was arrested for trying to view the vote counting. I myself was surrounded by six members of the Los Angeles County Sheriff's department when I had the audacity to ask if I could view the vote counting there, which was taking place in a room no one could see. We expect to get many reports from citizens who are not allowed to view vote counting.
If you are obstructed from viewing the central tally process, report it.
- In the 10 days following the election, you can expect to see many unusual things pop up in the public records that are obtained by candidates.
Of particular interest are the "event logs" that you get from Microsoft Windows, which runs most of the tallying software. This can show extra programs being run.
Also of great interest are the voting machine event logs, which can show crazy voting dates -- like in Palm Beach County in 2004, where more than 4 dozen voting machines had votes time and date-stamped weeks before the election, sometimes in the middle of the night, and Volusia County Florida in the same election, where a machine had votes date-stamped more than 10,000 years in the future. In San Diego in the June 2006 primary, the voting system event log shows that it dialed out to Diebold at 9:31 pm during the middle of its counting.
- We also anticipate many peculiarities with provisional votes, extra optional paper ballot votes, absentee votes and various obstructions to voting around the country.
- Another thing we look for is strange statistical patterns, like voting machines from one manufacturer giving results different from all the others, or one type of machine giving discrepant results, as happened in New Mexico in 2004. We saw three candidates in a row get 18,181 votes in Comal County Texas and one district in Minnesota had all the minor party candidates get the same vote percentage -- despite very big differences in how well known the candidates were.
On election day itself, we'll see vote-flipping, where people vote for one candidate and another one's name pops up. And we'll see many other unusual things.
I expect surprising new problems, like the new electronic poll books having problems finding themselves, and voting machines that don't match themselves (for example, having different results on their paper tape than they do on their screens).
Document. Think photos, videos, and most of all, cleverly constructed requests for documents. You have the right to obtain a copy of just about any document you can think of, as long as it exists. Go hunting. See what you find.
When you find important information, propagate it. Don't just call it into one place, but e-mail it, send it to bloggers, give it to reporters, provide it to public officials.
We want to improve elections, but first we need to make a solid, indisputable case. And to do that, we all need to get into action.
Use your own common sense. Document. Propagate. Then push solutions through for true citizen oversight. Now is your chance to take back your electoral process!

The same watchword motto can be applied to today's electoral processes. But so can a variation on the same theme: "Pray, but actify."
James said that "Faith without works is dead." Well, today is a day of reckoning in every town, every village, every hamlet all across this country. This is from the problematic San Diego County. It seems the corrupt County Registrar, Mikel Haas continues with his dirty tricks. California affects everyone in this country. We need to change our elections. We need to demand laws that make it easy for citizens to vote and to have all votes counted. Enough is enough.
San Diego Judge Denies Writ Seeking to Force County to Count Paper Ballots as 'Normal Ballots' as Ordered by CA Secretary of State--Registrar Mikel Haas' Promise to Defy the SoS and NOT Count Paper Ballots Until Thursday Moves Forward==VelvetRevolution.us Helping to Fund Appeal
The lawsuit brought last week in San Diego to force Registrar Mikel Haas to obey an order from the Secretary of State's office that paper ballots should be counted as "normal ballots" was denied in San Diego Superior Court today.
The writ, originally filed in Appeals Court last week, was denied on jurisdictional grounds and refiled in the Superior Court. Due to time constraints at that point, the section of the complaint seeking to stop voting machine "sleepovers" (which have now been ongoing for a full three weeks in the county) was dropped when the case was re-filed.
The denial today, which had also sought to force Haas to inform San Diego voters at the polls of their right to vote on a paper ballot, will be appealed according to Carlsbad, CA attorney Ken Simpkins. Election Integrity organization VelvetRevolution.us' Strike Force continues to raise money to fund such court actions, as it did with the original filing and several others — including the contested Francine Busby/Brian Bilbray special U.S. House election last Summer.
I spoke with Simpkins earlier today about the court ruling and the Judge who didn't seem to understand the differences between provisional, absentee and "normal ballots". Paper ballots, requested by any California voter, are supposed to be counted as "normal ballots" on election night, according to a memo from the CA SoS.
As time is way short for me right now, here's a quick transcript of my notes of the conversation I had with Simpkins, describing the judge who reportedly made his feelings known early on during the questioning when he referred to E-Voting as "the appropriate wave of the future"…
Got in there [Superior Court] at 8:30am this morning, and nobody seemed to know about the writ or when it would be heard. Someone got the judge on the phone, and a staffer reported that he said originally 'I'm not gonna hear the writ today and I'm not gonna recuse myself.'
I go to the residing Judge's office and told the story. A few minutes later I'm told "we just heard from Vargas' dept. and he decided to hear the writ at 10:30am"
At the hearing: Judge entertained about 20 mins of oral argument.
Would not concede that counting paper ballots on the Thursday after the election (while "counting" the machine votes on Election night) was an equal protection issue.
His questions made clear that, in his mind, "as long as the ballots are being counted at all, there's no equal protection issue." To him, "a provisional ballot was the same as an absentee ballot which was the same as paper ballots" at the polls as ordered by the SoS to be counted as "a normal ballot" (as opposed to an absentee or provisional which is checked for validity first before being counted or not).
Judge just seemed to not understand that by counting the paper ballots on Thursday, instead of on Election Night as "normal ballots" [San Diego County Registrar Mikel] Haas has created a new class of ballots. And that you can't discriminate against those ballots.
You could tell by the Judge's questions from the beginning where he was going. He was talking about these electronic voting machines as "the appropriate wave of the future."
The whole thing was just somewhat surreal.

I was also in the gallery and the judge kept confusing absentee ballots, where the signature has to be verified before the ballot can be counted, with paper ballots cast at the polls, where the voter has already signed the voter registration book before being allowed to cast a vote and no further signature verification is required. Obviously it takes much longer to verify signatures than to just run ballots through scanners.
It appears that the judge did not happen to see the HBO special, "Hacking Democracy," and is not aware that Diebold doesn't always tell the truth, and that elections officials don't always comply with the law.
In this case, Haas has said that that he cannot comply with the Secretary of State's directives to make paper ballots available to any voter who wants one, and to treat them as normal ballots, because Haas believes it would be "inconvenient" for him to do that.
I've already chipped in $100 and I'm hoping for a miracle–that this decision can be appealed and possibly even reversed.

Last-minute snub
The president and his staff were offended by the last-minute snub by Charlie Crist, the Republican candidate to succeed term-limited Florida Gov. Jeb Bush. The White House scheduled the stop here in the conservative Panhandle as a favor to Jeb Bush entirely for Crist's benefit. But Crist decided to go elsewhere in the state. The White House schedule Monday morning still listed Crist as introducing the president.
Rove did not hide his consternation: "Rather than being with the governor and the president and 10,000 people in Pensacola, they made a last-minute decision to go to Palm Beach. Let's look at the comparison. Let's see how many people show up in Palm Beach on 24 hours' notice versus 8,000 or 9,000 people in Pensacola."
The president was left with a rainy-day rally here for no one. The local congressman does not face a competitive race and the Bush brothers are estranged from Rep. Katherine Harris, the GOP Senate candidate, who polls show losing in a rout. Harris was given a three-minute speaking slot more than an hour before the president arrived and was not on stage during his appearance. Bush never uttered her name.

Let's hope that voter suppression and cheating are widely publicized. Here, Republicans were afraid of slipshod checking of signatures and Democrats were worrying more about electronic machines. Voting machine problems bedevil at least three states
Election machine glitches caused delays and jangled nerves in at least three states today as voters began turning out for midterm elections that could set the tone for the last two years of President Bush's term in office.
Up for grabs are all 435 House seats, 33 Senate seats and governorships in 36 states as well as ballot initiatives in some states on such topics as gay marriage and stem-cell research.
Voting was delayed in dozens of precincts in Indiana and Ohio, while in Florida some election officials had little choice but to turn to paper ballots instead.
"We got five machines — one of them's got to work," said Willette Scullank, a troubleshooter from the Cuyahoga County, Ohio, elections board.
Election officials in Delaware County, Ind., planned to seek a court order to extend voting after an apparent computer error prevented voters from casting ballots in 75 precincts. Delaware County Clerk Karen Wenger said the cards that activate the machines were programmed incorrectly.
"We are working with precincts one-by-one over the telephone to get the problem fixed," Wenger said.

Alot of schools are closed in areas near rivers, of which we have alot - Snohomish, Skykomish, Stillaguamish etc. - love those Native American names!

The Democratic presidential candidate won in 1992 and again in ‘96. He was impeached. The next Democratic presidential candidate to run won in 2000 by at least 500,000 votes nationwide, and in Florida by at least 16,000 votes that we know of. All one need do to confirm this is to reverse the definitive computer glitch in Velusia County alone which the board of elections has proved actually subtracted over 16,000 votes from Al Gore, thus fabricating George W. Bush’s 527 vote margin of victory.

The next Democratic presidential candidate won yet another mathematical victory in 2004, and this time by a margin the exit polls and regression data now show to be an incredible five to eight million votes nationwide. The aggregated exit polls have never been wrong by even their specified 3% in all the years that they’ve been exercised. Yet in 2004 they showed a 6% error against 100 million votes. Analysts place the probability of such an error at 16,000,000:1 (one chance in sixteen million).2
If we halve the statistical margin, hell, if we quarter it, Kerry still wins.

If you don't think even a few calls makes a difference...I just talked to an elderly woman who had tried to find her polling place but couldn't find it. When I said I'm calling to remind you to vote, she said "I tried to vote, but I couldn't find the place." I kept her on the line, went to the DFL website, found her polling location and told her where to vote. She thanked me enthusiastically and said she was going to vote right away.
It makes a difference.

Voting nightmare: Democrats seek extension

Democratic party leaders are planning to seek a two-hour extension for voting in Denver, due to massive computer problems which have created long lines, and kept many from casting their vote.
Party spokesman Brian Mason said a motion is being prepared, in response to "the huge problems in Denver this morning."
The problems began right at 7 a.m. as computer problems at the voter-check in stations bogged down, creating a bottleneck in the first hour of voting as a rush to the polls overloaded the system.

"It's just like traffic on (Interstate) 25," Coles said. "It's as if we are building two more I-25s right next to it" to ease the traffic congestion.
But the fix did not come in time to help some voters who hoped to vote before heading to work.
At Denver Botanic Gardens, more than 200 voters backed up in a line that stretched out of the gates and down the block more than half way to 11th Avenue.
"We will not get to vote today," said a frustrated Lauren Brockman as he left the Botanic Gardens.
He lined up at 6:45 a.m. hoping to beat the rush, only to stand in line for close to an hour before leaving.
But an hour wait was short, compared to some.

Just to let everyone know, I called Rhode Island at 9 A.M. central and spoke with Amy. She told me they had enough people and that they were "saturated". She was going to call back if needed help and I have not heard from her. She sounded a bit more optimistic than I expected. Let's hope all is well in Rhode Island.

Today is the end of the electronic voting machine

Republicans are complaining about voting irregularities as loudly as we are today. A Republican governor, two Republican congressmen turned away from the polls. Votes supposedly switching in electronic voting machines in New Jersey. Complaints coming from New Mexico and elsewhere.
Here's the bottom line -- no one trusts those machines anymore. And not only do they damage the integrity of our democracy, but they give losing campaigns an excuse to grandstand and further erode faith in our system. Paper ballots (or optical scan) is a solution, but it doesn't solve the problem of voter turnout, voter intimidation, the problems with inclement weather, and lack of voter education when entering the booth.
Jeremy Wright has led a campaign to promote Oregon-style vote by mail (which is now in place in most of Washington state). He just posted a diary on the mechanics of it.
It's clear the current system is broken. We have dumped hundreds of millions of dollars and it's not getting any better. Time to cut our losses and look at the most sensible solution available.
--NOTE - In Washington most of us vote by mail now and it's such a good thing, as we're all flooded and in an emergency state today with National Guards rescuing people in areas near water, thousands of school children at home.

Trained election officials then match the signature on each ballot against the signature on each voter's registration card, before processing the vote.

Just heard this story that came from one of our volunteers in Milford… apparently, he was the only person from any campaign pollstanding at a polling place in Milford earlier this morning. All of a sudden, two or three out-of-state (Fox News vans ccompanied by a Fox News crew) pull up and unload a bunch of Lieberman lawn signs, placed right in front of the Lamont signs that had already been planted. And, what do you know, after a few more minutes, who shows up but Joe himself, ready for the cameras.

Democrats not fazed by flooded polls
The most likely effect of rain on the elections at this point will be delay in knowing the outcome of the hotly contested 8th District Congressional race between U.S. Rep. Dave Reichert and challenger Darcy Burner, said Democratic spokesman Kelly Steele.
Rain could slow the count of absentee ballots, which could delay results even further than anticipated. Because of the closeness of that race, party officials hadn't expected to know the outcome by Tuesday night.
Otherwise, the rainy weather doesn't appear to have dampened voter or volunteer enthusiasm, he said.
"Thousands of volunteers have shown up and are still doing phone calling and canvassing," he said. "Each county and each situation deals with it (the weather) a little differently."
Voters seem to be finding their way to either their own polling place, or in a few cases, alternative polling places, Steele said.
"Eighty percent of Washington voters have already voted," he said. "This has been a three-week long election day."

I just got back from a horendous day. Placing signs everywhere in freezing pouring rain! I just got back and voted. Turnout was quite high all day long. I can't decide what it fortells for my area! The signs didn't really come out in force until today. I know one precinct chair on the Republican side has had extra signs sitting by her house for people to pick up for free--and yet they have been sitting there untaken for weeks!
I feel like I can't breathe. The excitement, fear and worry is similar to 04.
I hope that the way the media ignored 04's election problems will come to bite them in the butt.
And remember the Republican party is the ones that refused to look into machine problems in 04. Will this get them in the keister too?

A call to you lawyers out there: Is there any chance this fellow can claim self-defense? From the AP: “A man was arrested at a polling site Tuesday after election workers said he smashed an electronic voting machine with a paperweight, police said. Michael Young, 43, of Allentown, will face charges of felony criminal mischief and tampering with voting machines, Assistant Police Chief Ronald Manescu said. … "He came in here very peaceably and showed his ID, then he got on the machine and just snapped," volunteer Gladys Pezoldt told The Morning Call of Allentown.
Things got off to a rocky start in Ohio – needless to say – but appear to be getting better. From the Cleveland Plain Dealer: “As of 12:30 p.m. all polling places in Cuyahoga County were using electronic voting machines, a Board of Elections spokesman said. However, it’s not clear whether all machines are working at every polling place. … This morning, more than 40 polling places in Cuyahoga County reported problems when the polls opened.”

Maybe there are reports out there of these screw-ups benefiting Democratic candidates at the expense of their Republican opponents, but I just don’t come across them. From TPM Café: “My wife just came home from voting here in Webster Groves MO. She used the electronic touch-screen voting system. . . She touched Claire McCaskill's picture and the machine recorded a vote for Jim Talent. She then called one of the people running the polling center who helped her correct the problem. My wife then had to call the person over another time after it recorded her vote a Republican again. In her frustration she asked the person who was responsible for the design of this system. The polling person leaned in very close to my wife and whispered, 'We're f----d.' "
No liberal conspiracy, this distaste for electronic voting machines. Why Republican National Committee Chairman Ken Mehlman and conservative commentator Bob Novak have been caught with their hands inside the paper-ballot box … despite having the option to e-vote, according to Talking Points Memo.
At the risk of appearing to be fair, it’s worth noting that optical scanning equipment didn’t do much better at one Ohio polling place, where a member of Congress attempting to vote for herself (presumably) was both thwarted and filmed.
The Daily Advertiser in Louisiana leaves no malfunctioning voting machine unturned: “A mechanic is on the way to the former St. Antoine Elementary School to check on a voting machine that is reportedly malfunctioning, said Lafayette Parish Clerk of Court Louis Perret.” … We’ll be sure to keep an eye on the situation at St. Antoine Elementary School.
From the AP: “WASHINGTON — Voting machines began wreaking havoc the minute the polls opened Tuesday, delaying voters in dozens of Indiana and Ohio precincts and leaving some in Florida with little choice but turn to paper ballots instead.”
From The CourierPost in New Jersey: About 30 of Camden County's 700 voting machines have experienced problems today, according to Phyllis Pearl, superintendent of elections.”
From Pittsburgh.com: “A few hours after the polls opened, there were problems reported with electronic voting machines.”
From CBS4.com in Florida: “Voters are urged to cast their ballots carefully as scattered reports of election machine glitches have been reported around South Florida during early voting. CBS4’s Dave Malkoff spoke to early voter, John Mabe who claims when he cast his vote at the Lemon City library early voting facility for Jim Davis, the machine registered Charlie Crist as the correct vote.”
From The State in South Carolina: “The first known technology glitch in today’s election has occurred, and that in the state office responsible for overseeing the election. The S.C. Election Commission’s Web site, www.scvotes.org, went down shortly before 8:30 a.m.”
From LancasterOnline in Pa.: “Voters at several polls around Lancaster County have reported issues using electronic touch-screen voting machines. Reports from Lancaster’s 9th Ward, fourth precinct; 2nd Ward, first and second precincts; 6th Ward, first precinct; 8th Ward, eighth and ninth precinct; and Manheim Township’s 7th district had reports of malfunctioning machines and/or voter confusion about how to use the electronic machines.”
Update from NBC in Columbus, Ohio: Even efforts to address the problem are causing problems … “A flood of election-related calls knocked out the phone system serving Franklin County offices on Tuesday morning. County Elections Director Matthew Damschroder said the phone lines were overwhelmed by voters wondering where to vote and poll workers needing help with electronic voting machines.”
Another update: From Central Florida News 13: Seems that spring ahead/fall back stuff was too tricky for some of the machines. “Glitches are showing up on touch screen voting machines in Volusia and other counties around Central Florida. The Volusia Supervisor of Elections says the problems started showing up when the automatic clock inside the machines did not reset to make up for Daylight Saving Time.”
One more: They’re voting in California now, which, of course, means that the machines are balking there, too. From SignOnSanDiego.com: “Computerized voting machines in several parts of the county weren't working early Tuesday morning and voters were forced to use paper ballots instead. But a county spokesman said there had been no reports of widespread problems with the machines. Voting machine glitches were reported in Birdland, City Heights, South Park, La Mesa and National City.”
Can’t call this one a “glitch:” From WMC TV in Memphis comes news of a major snafu where the Democratic candidate for U.S. Senate has already filed a challenge: With Tennessee voters going to the polls, Harold Ford Jr. claimed this morning that polling locations in Memphis and in Jackson shut down because their voting machines weren't working. 'They told all the polling workers to go home and the election officials to go home without giving any real guidance to voters. We've already leveled one (challenge) on behalf of voters who have been told they'd have to wait until later today to vote,' Ford said."
More trouble out West, this one steaming those who like to vote before getting to work. From The Daily Herald in Utah: “Encoder problems at most, if not all, of the 118 voting stations left early morning voters standing in line for more than an hour waiting to cast their electronic ballots. There were problems with the encoders at most, if not all, of the polls in Utah County, said Sandy Hoffmann, elections coordinator for Utah County, but all of the problems have been remedied.”
This one seems to qualify as an exception to the rule in that it cites only a single problem. From the Roanoke Times in Virginia: “Turnout in today’s election was steady in the Roanoke and New River valleys, with at least one voting machine glitch causing a slight backup.”
In South Carolina the problems are causing bad-hair days. From MyrtleBeach.com: “Sandy Martin, Voters Registration & Election director for Horry County, said she felt like pulling her hair out because of the chaos of Tuesday morning. I don't have a lot of hair, and I don't need to be pulling it out," said Martin of her blond-brown locks. "It's been chaotic. It's been a hectic morning."

Observer, Fox polls show gains for Democrats in Senate

Fox News Channel is reporting live on air strong showings for Democrats in six key Senate races, with Republicans maintaining three seats. Fox failed to disclose which seats were in play, saying they didn't want to affect voter turnout.

CNN projects Democratic wins for incumbent West Virginia Senator Robert Byrd and Ted Strickland in the Ohio gubernatorial race.
(CNN) -- A Republican incumbent trailed Tuesday in early results in a much-watched U.S. House race in Indiana, which may be an early indicator of voter sentiment that could swing control of the chamber.
With 15 percent of precincts reporting in Indiana's 8th Congressional District, Rep. John Hostettler trailed Democrat Brad Ellsworth 70 percent to 30 percent.

The MN governor's race went from Hatch out in the lead to a statistical dead heat with Hatch only a few thousand votes ahead, and now it seems the Con is a few thousand in the lead, but the two are still a statistical dead heat.

State law says that if the difference for any race is less than one half of one percent that there's a recount. Looks like there has to be a recount in the Hennepin Co. sheriff's race anyway, since that one is too close to call, too.

I can go to sleep now...my state is BLUE! It's been a good night for the american people...a good start at rectifying the wrong that has been done over the last 6 years.
Jeffrey Toobin saying a recount in VA is less likely since the margin is now 11000+ (instead of 1500 like it was when the recount talk began)...also looking like Montana will go to the dem
